I can't imagine "It's a confusing format already, so I should be allowed to use a misprint which misleads people about what card I'm playing" would persuade many HJ's to let you play the Wald misprint
Yeah having winrates would probably be needed. It might be possible to determine winrates empirically using available data. Not sure how much accessible tournament data is out there.

I think TNN UR decks are definitely viable; four of the last five UR decks to place in top 16 of 100+person tournaments have had at least 1 TNN
