Hi all, I need some help. I have about a 170 rating on eBay and have never dealt with not recieving an item until now. I was going to buy a whole Type 2 Faeries Deck for a tourney but I never received the Sowers, Bitterblossoms, or Sunken Ruins, that's a hurting on my wallet. I've already stated a claim against the guy with Sunken Ruins and he hasn't said anything for about a month and a half after all my messages. The Bitterblossoms were sent from Canada so I figured it would take awhile but not more than a month. No word from the Sowers guy. I'm going to file a dispute with the other two guys, but my question is. What is going to happen if I file claims? will I get the money? anything I need to watch out for? I just can't afford a $150 loss. Any help?

During my dealing with ebay and paypal I have had this happen.
If they are verified-Means they are connected to a checking account.
If there is money there then you can get it back.
If they have no money in there account your out of luck.
This is why a lot of people will not sell or buy from non-verified persons since it is real easy to get a pre-paid card and use it to set up a pay-pal account then link it to an ebay account.

Last I remember, Paypal's seller protection policy required them to prove they sent the item within 7 to 10 days. If they couldn't it's almost automatic that anything filed against them is going to be returned to the seller.
Typically I will leave about 2 weeks time from the day after my payment to give anybody in the continental US a grace period before I contact them for an update. If I don't receive word back or the cards by the next week, I will file against them immediately. For Canada, it's almost always the same, though I tend to give a little extra time if it's like way up in the NE section. Their mailing system isn't any slower than ours, really.
I also almost never buy from outside the continent, unless it's absolutely necessary. I also check for buyer protection policies to see whether or not their country is covered (in most cases they are). A lot of times you'll end up waiting a month for the item, and I'm really not that patient if I'm shopping on ebay.
As far as the filing goes, you don't have to do anything once it's started. They'll send a "timed reply" email to the seller's email address, giving them X number of days to get back to them. If they don't, the money is automatically refunded. If they do, they have to explain their case, and give the proper paperwork to them (shipment receipts, etc), and paypal has to verify whether or not you got the item. Chances are though, once you've filed against them, they'll just refund the money, or out of the blue get in touch with you and let you know where the cards are.
EDIT: And what Fanatic said. Don't buy from non-verified people (except me, cause I'm awesome. I just haven't added my bank account yet >_<)
Also, depending on the file, they can still take money back from a Paypal account that has no $ in it. It happened to my old business account when I had pending sales and was forced to close it, they hit me with 2 chargebacks and locked it on me. So depending on what level they are (business, personal, etc) they can probably get away with getting the money back to you regardless, and just lock the account if they don't get the negative balance back up in a certain amount of time.

I filed a claim once, Paypal got me the money back within a month. The only way he can prove that you got the cards, is if you signed on receiving them as far as I know. Biggest problem is, however, that you probably won't get your deck finished when you want to.
Also, don't wait to long before filing, there's a limited time-window in which you can.

Thanks everyone, I filed disputes over the other stuff so how much time should I give them to reply and go up to a claim? I kinda feel like a dick but it's the only way to get my money back then that's what it's got to be.

You can't be seen as the bad guy given you've waited more than enough time to receive your cards. I'd say give it a couple days at most before you up it to claim, as they've had more than enough time to get back to you. Just make sure you follow what Paypal says, and you'll be fine.

Yeah... It was rather disappointing, as those cards were meant to be in my block ptq season decks... :frown:... needless to say, I missed all 3 I was intending on going to after these purchases.
Don't wait any longer in PayPal. As soon as you file the claim, escalate it immediately, or you risk really never getting your money back. Any seller who has dicked around this long isn't going to just suddenly now start to respond to your emails. Attack with no mercy until you've gotten refunded.
you could also pay a visit to their houses, a trip to canada sounds fun.
