So I recently bought a korean volrath's stronghold on ebay. The auction didn't contain a picture of the card, but the seller had a ton of feedback so I wasn't too worried. The card arrived and of course it was chinese. I started talking to the seller about how to resolve this and it became quite clear that he was blatantly lying and knew that he was selling chinese cards as korean the whole time. After doing some more digging I found out he used to be part owner of a card shop so he obviously knows what he is doing.

Anyway here is the main issue. He only wants to issue a refund after I return the item. I think this is absolute bullcrap for a number of reasons.
1- How am I to trust him? He obviously tried to rip me off already so why should I expect him to refund me after I return the card.
2- Why should I be responsible to return the card at all? For all intensive purposes I didn't receive the item I bought. I should receive a full refund. Then he should pay for any shipping costs to ship his worthless card back to him.
3- Why would he ever stop pulling this shit if he never loses out. If he were responsible for paying for return shipping and what not he would stop trying to scam people, but he basically has nothing to lose by listing chinese cards as korean.

This isn't really a monetary issue. It is just me being pissed off that I wasted my time because this guy is blatantly trying to rip people off and will continue doing this. Anyone have any suggestions?

To be honest, just get your money back and move on. Losing a few bucks in shipping costs is no matter.

Almost same thing happened to me, I thought I was buying a Japanese NM Jitte, it turned out to be a played Chinese. I filed a dispute, seller then refunded my money. I sent the card back to him then left a negative feedback afterwards. I know how you feel and it's not really worth the time dealing with this kind of sellers.

I really don't care about the money. The point is I want to screw him over as he is obviously committing a fraud. Would I be able to file mail fraud for this?

If I were you I would file a complaint with paypal and say that the item was signifigantly different than described. You don't have to send the item back and paypal gives you your refund (taking the money from him). I know it isn't about the money but it does suck for them and put a mark agains them on there paypal account. If it happens to many times to them they get banned.

If you were really bitter you could ask fellow sourcers to buy things from him and when he sends the wrong card have them file similar disputes until he is banned.

You're probably going to have to send it back, with tracking, at your expense. Do that, get a refund, and leave a negative that explains the Chinese/Korean issue. There are millions of Magic players who cannot differentiate between the Asian languages; it's totally possible that he's one of them and there's no malicious intent.

No, in that case people would refer to Chinese, Japanese or Asian. Korean is way too specific.

As for the thread's "intensive purpose": UrDarco is correct. File a complaint that the item was not what you paid for. You get your money and the item, and this dude looks like a total Douche. Win-Win-Win.

Even worse, someone was selling a Natural order korean with the actual picture of the card ... that was chinese.
So i notice him it's not korean, then he wanted to know if i was sure about it, hence i send him 2 different links of autions concerning a chinese and a korean natural order (with picture ofc) proving my point.
1 week later (after his auction end) he put it back for sell with this label : Natural order maybe Korean.

Your second suggestion is outright fraud, far worse than anything the seller did.

1- Why wouldn't you trust him? eBay's system is skewed way in the favor of the buyer anyway. He didn't try to rip you off, he at worst wrote an incorrect description about something he probably didn't think most people even care about.
2- Because that's not how the system works. And again, this system is skewed way in your favor.
3- Getting negative feedback/negative seller rating/a refund mark against him/etc does hurt him - a lot. If he makes very many buyers unhappy at all, his bottom line gets hurt bigtime.

Return the card, get your refund, leave negative feedback/rating, suck it up, and forget about it.

No, that's not true. A lot of people will "know" that it's Korean, even if it's not. I recently bought a "Korean" Academy that turned out to be Chinese. I asked the seller about it, he said that EVERYONE at his shop told him it was Korean. I've seen numerous people try to sell "Korean" foils, which obviously don't exist. A lot of folks will just assume that it's Korean because that's what they think it is.

Parts of the system are, but this part is not. If the SELLER fucks up, the BUYER has to pay to ship the item back, even if it's 100% the seller's fault. If I buy an item that's listed as "Foil Tarmogoyf" and the seller sends me a nonfoil one, I have to pay to ship it back, with tracking. I have to waste my time and money because the seller fucked up. Why is this in my favor again? Some parts of ebay rules favor the seller, and some favor the buyer. Life isn't fair. Generally I just leave a negative and don't bother wasting my time and money over a $5-10 difference. If the seller really cared, they could have done better in the first place. I am NOT someone you want to fuck with on ebay.

What I meant by my second suggestion was to have others order "korean" cards and give him negative feedback for lying/being incorrect. The seller has to correctly list what he is selling. I don't understand why this is fraud.
