Cheating or clever use of the rules?

I wish this judge could come in here and sort things out. A judge telling a player, "you didn't physically pick up your deck fast enough" doesn't sound like something that would be said.

Unfortunately judges can and do make mistakes. Maybe the requirements for being a level 1 are too low, and the judge promos are too tempting a prize.
